The Immigration and Refugee Board of Canada decides and places the applicants in one of the categories. When a person is expelled from their country and cannot return to it or the country where they previously lived, they are considered convention refugees. The claimant is abroad because they have a legitimate fear of being persecuted because of their race, religion, nationality, membership in a particular social group, or political beliefs. These elements compel the claimant to look for refuge outside of the nation of residence.The second sort of refugee is someone in need of protection who lives in Canada and cannot return to their home country due to the risk of torture, danger to one’s life, or cruel and unusual treatment or punishment.
